How is a privilege of the property where the business is no longer in business?
About 10 years ago about, I lived with my mother and had financed vinyl siding on my name for it. He transferred the land and house for my name to finance. This debt was canceled years ago – Did not even know he had placed a lien on the subject. The company is bankrupt, and my mother is trying to sell this house and go on another's property person. We have no documentation and find nothing on my credit report to prove he was paid. The seller told us it is a privilege of 14 years and have 4 years deadline. We are in Texas. Is there anything I can do – my mother and aunt to live with me – no way I can wait 4 years to move. They are fixed-income and only option because they already have land. Please help! The new bank will not process the loan without a clear title. The debt was paid, but we have no more records. He knew nothing about the privilege, and never thought that the house would sell.
I would like to proceedings against the company for slander of title. This will require to go to court to confirm that this privilege is called a mechanics lien or privilege contractor. No-shows (which probably should be the case) the judge should throw this law is inapplicable. I really think that a lawyer should be able to take care of this pretty easy! Good luck!
