Why is my video being blocked on youtube?
I posted an AMV about a week, maybe two ago. After posting it, i found that it was blocked in some countries. I disputed the claim with the following statement
“I have followed the copyright law correctly, its non-profit and the songs are credited.” or “Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for “fair use” for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use.”
For a few hours the video was fine, viewable by everyone. Now however, it is blocked worldwide, the WGM is claiming copyright on the song Brick By Boring Brick, by Paramore.
I’d like to know why?
You misinterpret the laws. You failed to follow YouTube guidelines (see #2 below) and posted copyrighted materials. No disclaimer is sufficient. Giving credit does not excuse your actions.
You do not qualify for “fair use”. BTW – fair use is usually limited to 10 seconds or less
- You are not a non-profit entity (non-profit is a type of business model)
- You are not news reporting
- You are not teaching (which refers to institutes of learning)
- Your video is not part of a body of research
- Your video is not part of a scholarship program
- Your video is not part of a teaching curriculum
- You are not using this video in a critical perspective
Finally, you are NOT following the copyright laws correctly.

A Few Guiding Principles (taken from YouTube Help pages)
1) It doesn’t matter how long or short the clip is, or exactly how it got to YouTube. If you taped it off cable, videotaped your TV screen, or downloaded it from some other website, it is still copyrighted, and requires the copyright owner’s permission to distribute.
2) It doesn’t matter whether or not you give credit to the owner/author/songwriter—it is still copyrighted.
3) It doesn’t matter that you are not selling the video for money—it is still copyrighted.
4) It doesn’t matter whether or not the video contains a copyright notice—it is still copyrighted.
5) It doesn’t matter whether other similar videos appear on our site—it is still copyrighted.
6) It doesn’t matter if you created a video made of short clips of copyrighted content—even though you edited it together, the content is still copyrighted.

If I robbed a bank but the note I handed to the teller had a disclaimer on it saying “No crime intended”… would that excuse me?
