What can I send this collection agency that will make them remove their info on my credit report?
I swear that Midland is the worst of the bottom feeding zombie debt collectors ever. The original debt is almost 10 years old (well beyond the sol) and they refuse to go away. The original creditor is still listed because Midland keeps it there. Midland reports a new account every 30 days with a 30 day term on it. Now I have 2 original debts (dod 1998) and 18 listings with Midland. The original debt was $195 and $346 Midland lists them at a range of $600-$3600. I dispute them every month and each is listed as “Account is disputed under Fair Credit Reporting Act” But they never go away. I have sent multiple DV letters and each has been recieved but not responded to. What can I do to finally get them to go away?
What I would recommend is to send is to send a certified letter that states something along the lines on the following:
(Date)
To Whom It May Concern:
I have been contacted by your company about a debt you allege I owe. I am instructing you not to contact me further in connection with this debt. Under the Fair Debt Collection Practices Act, a federal law, you may not contact me further once I have notified you not to do so.
Sincerely,
(Name)
(Account No.)
Give them 60 days to stop bothering you and if that does not work you can try a couple of these more “extreme” options:
*file a lawsuit against the collection company for violation of “Fair Debt Collection Practices Act”
*Get a restraining order against the company
It may be helpful to contact your state consumer protection office for advice and to file a complaint
