Is it too soon for a pay for delete?
All right well I am in the process of fixing my credit. I have two minor medical collections on my report that are about $120 a piece. I live in Texas and these debts are from about 2005 and 2006. I know there is a 4 year window that a collection company can sue you. I am trying to do a pay for delete. Since the four year window has not expired if I send a pay for delete do you think that can cause the collection company to try and sue? What can the negative consequenses be if I request a pay for delete and it hasn’t been at least four years yet. I know the older the debt is the more bargaining power I have. Help me out guys cause I really hope this works.
Medical accounts differ from regular money debts because of HIPAA and states medical privacy laws.
You should exercise your HIPAA and your states medical privacy laws and deal with the original medical provider.
If you pay the original medical provider (best if done by money order or “bank” cashiers check) then the collector cannot legally continue to report as it would violate Public Law 104-191 (HIPAA).
Once there is no longer any payment due there is no permissible business purpose in divulging protected health information to anyone on an account – which means the collector can no longer legally hold the account or report it. The collector must return the debt to the original medical provider, purge their files of the debt and remove it from your reports.
Be very careful, when paying, that the medical provider does not turn the payment over to the collector.
If you are seeking protection under HIPAA, etc. your payment to the original medical provider must be made for the “full” amount due.
