How do I fix a judgement against me?
I filed bankruptcy last February and since then one of my creditors had me served with a summons, which they were not allowed to do. I called my lawyer and he said he would take care of it and I never heard about it again. I checked my credit reports and the judgement appears on all three. My lawyer’s office said to dispute the item to get it off my credit report, but won’t I have to go through the legal system to clear myself?
You didn’t mention what chapter you filed under. Just because you cannot be taken to court for the debt, it will still remain on your credit report under the CRA guidlines for reporting judgements.
Either way, the bankruptcy will still show on your credit report
Example Chapter 7:
You file bankruptcy on January 10, 2003 and receive a discharge on May 30, 2003. The bankruptcy remains on your credit report until May 2013. (10 years)
Example Chapter 11:
You file bankruptcy on January 10, 2003. You receive confirmation of your chapter 11 plan on March 15, 2003. The bankruptcy remains on your credit report until March 2013. (10 years)
Example Chapter 12 and 13:
The court normally grants the discharge as soon as practicable after you complete all payments under your repayment plan (typically 3-5 years).
