In California, what can be done to someone who takes out a credit card in his dead fathers name and uses it?
This person obtained a credit card using his dead fathers name. Their name is the same(named after his dad). I’m pretty sure he used his fathers social security number etc. to get the card. He has ran it up to about $10,000.00 so far. Can a civilian report him and have him prosecuted, or does the bank have to do that? If so, who does one report it to, and what kind of penalties would this person be facing? I would appreciate any help anyone could give me on this. Thank You
Here is the law for California:
Section 532a, subdivision (4), provides in relevant part: “Any person committing a public offense under subdivision (1), (2), or (3) shall be guilty of a misdemeanor . . . . Any person who violates the provisions of subdivision (1), (2), or (3), by using a fictitious name, social security number, business name, or business address, or by falsely representing himself or herself to be another person or another business, is guilty of a felony . . . .”
So yes, this person has committed a Felony. Report it to the Califonia Attorney Generals Office.
